If you ever run into a pair of individuals called Peter and John Buckle don't have anything to do with them I have been scammed for £3500 by this pair - a deathtrap vehicle with screens held on by bathroom sealant - holes in the sills, an illegal plate, bits of different cars - it's an absolute wreck. They've obviously done this before. I have been diagnosed with cancer and FMS and I need a working vehicle which now I don't have to get to treatment appointments (you can't use public transport if you need chemo or radiation therapy). My bank HSBC are telling me they're not going to help me because I "got what I paid for" despite it not being roadworthy (I specifically said that I needed a daily driver vehicle) , the right car, the right plate... Avoid them like the plague as well, despite the fact that action fraud, police, trading standards and other legal experts have said that they have to pay the money back re the fraud code of conduct for UK banks.
I'm at my wits end and my health has completely collapsed.
In all I've been scammed for over £7000 (PayPal illegally denied me information about a fraudulent account and as a result I lost £4k there) and I can't get help anywhere. I'm being treated like the criminal. I don't know what to do or where to turn.

Dear oh dear, Rosie. Very sorry to read all that. First port of call must be the Citizens Advice Bureau. Don't wait, do it straight away. They are a highly professional organisation and will be able to advise you correctly.
KBO,
Chris.

Hi Rosie
So sorry to hear of your health and financial predicament. As Chris says make an appointment with the Citizens Advice Bureau as soon as possible. If the Buckles have been selling cars which sounds as though it may be the case, they will be classified as traders and expected to know about the condition of the vehicle. Do you still have the advert that led you to these people?
Have you asked the hospital if they can arrange transport for you after your chemo /radio therapy if you explain your situation?
Good luck
David

So sorry to hear of your problems Rosie. CAB is the place for help and advice - they are very good (I used to be on the Management Committee of a local branch) When my late Wife was having radiotherapy and chemotherapy years ago she wasn’t allowed to drive. Regulations must have changed since then Dave

Hello Rosie. So sorry to hear of your predicament. Though I'm retired I operated a vehicle inspection business for 18 years and prior to that was employed doing the same type of work for the AA, in total that covered 32 years. In that time there was a never ending mount of work coming in to help people in exactly your situation. In my previous life I had acted as an expert witness in court, carried out inspections on behalf of various Trading Standards offices and acted as a vehicle expert for the BBC and ITV. Do you still have the vehicle in question?. I assume so, in which case you would need the vehicle inspected by an independent professionally qualified engineer who is able to produce CPR (Civil Procedure Rules and its amendments) part 35 reports. An engineer has to have this qualification to be able to present evidence in court. Once you have had your vehicle inspected, and a CPR part 35 report produced you would then be able to take action against the people that sold you the vehicle. I would bypass Citizens Advice and go straight to your local Trading Standards. They would no doubt ask that you have an independent inspection of the vehicle carried out and having already had that done this should speed the process up. I appreciate that this would be stressful for you but it may well be the only way you could have your money returned. One thing to keep in mind is folk like this know that most people won't go down the legal route because it is time consuming and stressful. It is difficult to find engineers qualified in this field but you could try www.eliteinspections.co.uk/ and ask to speak to Douglas Reid as he may well be able to help you. As with all things like this it is expensive to pursue but it may well be the only way you can get your money back. At the very least it would be worth having a chat with Douglas. Just to let you know i have no connection with Elite vehicle Inspections or Douglas Reid. All the best Steve

Steve, your professional advice to Rosie is much appreciated and will be helpful for any other readers who find themselves in such a situation.
All I would add is that it is important to try and make an assessment of whether the Buckles have assets and would be in a position to not only refund you for the price you paid but also your costs. If not you could end up even more out of pocket (the sad voice of experience from a non vehicle related incident many years ago).
Rosie, it would be helpful if you could post a a copy of the original advertisement and confirm that you did not purchase the vehicle on a sold as seen basis.
David

I second Steve's approach and wish I'd known how best to go about it 20 years ago when sold a pup (Ford Thunderbird)! Made mistake of going to general solicitor who was next to useless. Prof report and Trading Standards seems straightforward approach and again as Steve says, most get away with it as they bank on people giving up. I'm really sorry to hear about your situation but hope it gets resolved before too long. Andrew

With this and another scam I've lost the best part of £9k (including bank interest). PayPal refused me information about a fraudulent account and as a result I continued dealing with that person - despite PayPal acting as an accessory to fraud they have been legally abusive to me. Criminal activities are not protected under gdpr or data protection yet this is what PayPal is claiming. Its ridiculous. My health has totally collapsed and I am suicidal. I can't even think straight. The car was not sold as seen.. It was claimed to have passed Mots which I actually checked, it was claimed to be a show car and I SPECIFICALLY asked if it could be used as a daily driver and the answer was yes. I am in no condition to deal with any of this, I can't eat properly and I'm losing weight and sleep
I need help with this and as for citizens advice I want nothing to do with them due to previous experiences. I have tried to claim compensation from HSBC - sent photographic evidence - I accidentally put my hand through the bodywork! And I have apparently got what I paid for... I don't know what else to do
I considered getting an RAC inspection - but I can't afford the price risk that even a class 35? Inspection costs.
If anyone has any suggestions my direct mail is rosie[DOT]hawtrey[AT]gmail[DOT]com I am on £500 a month benefits - in itself because the NHS failed to diagnose my health condition for 30 years despite textbook symptoms.
I feel like I'm constantly fighting on my own and I don't even get what I'm entitled to let alone any help.

Hi Rosie, I've just sent over an email. Out of interest what car was it that you purchased? Steve It was supposed to be a black Wolseley 18/85 manual in daily driver condition - from Bournemouth - I couldn't get there to see it and the advert was a masterpiece - they've done it before. The only use for it is a restoration or a parts car but as a restoration it'd have to be a Six and reregistered. If anyone is interested I need to get back what I can so if anyone wants it as a parts car for £750-1000 or so. Interior really good and a few interesting parts on it such as aux lights etc. Sorry I have been away but this has had me in and out of hospital because bank tell me I got what I paid for and are refusing to help or even look at my evidence

Hi Rosie, I've just sent over an email. Out of interest what car was it that you purchased? Steve Registered as a 68 car JNH 329 F We've tried to find out if the Buckles have a business and they aren't listed at Companies House but the sets of keys both have those kind of inventory tags.. I wish I could prove they've done this before but I'm 100% sure of it. Its now gone to the financial ombudsman because my bank HSBC have told me that in their opinion I have got what I paid for - even after sending photographic evidence and other info including the illegal plate. Health utterly destroyed. Lost over a stone in weight and have been in an out of hospital several times with major stress related issues. And the best part - the other car has a clutch hydraulic problem - I can get the clutch to work once after pumping like mad, because of a leak in the circuit caused by road debris - that no one wants to touch because of all the cv19 mot havoc. Just can't get a break.

Unless anyone is interested in the black car it's just going to scrapped. A fair price as a parts car or a restoration project as I understand it is £850-1000. Has an almost perfect interior and other rarish parts included flat type driving lights that appear to bolt through the bodywork.
